Welcome to Cache Vibes. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally as an individual consumer or on behalf of an entity ("User", "Guest", "Registered User", "Host", or "Property Manager"), and CacheVibesEnt, Inc. ("Company", "we", "us", or "our"), concerning your access to and use of the Cache Vibes mobile applications (available on iOS and Android), software platforms, group coordination interfaces, web portals, and physical interactive hardware kiosks (collectively, the "Platform").
By downloading the application, accessing, or using the Platform, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.
1. NATURE OF SERVICE & ACCOUNTS
Cache Vibes operates an AI-native concierge, leisure discovery, and social coordination platform.
• The Interface: Our conversational AI assistant, Luna, facilitates travel, dining, nightlife, excursions, car rentals, and boat charter searches, aggregates individual/group preferences, and provides automated recommendations.
• No Agency Status: CacheVibesEnt, Inc. is not a licensed travel agency, direct transport carrier, hotel property, hospitality vendor, or event organizer.
• User Confirmation Requirement: The Platform’s AI components do not execute financial transactions autonomously. All bookings, reservation requests, and payments require explicit, intentional, and manual confirmation by the User within the interface.
• Account Registration: Individual B2C consumers may browse select features in limited "Guest Mode." Full access to pricing, personalized AI features, group planning tools, and bookings requires creating a Registered Account. You are responsible for maintaining the confidentiality of your account credentials.
2. SUBSCRIPTION TIERS & APP STORE COMPLIANCE
The Platform offers a multi-tier subscription and entitlement structure governing feature access:
• The Tiers: Entitlements are split across four distinct tiers: (1) Guest Mode / "Cache Vibes" Free Tier, (2) Standard Retainer Tier, (3) Premium "Cache Private" Tier, and (4) Black Label Tier. Tiers dictate UI palettes, feature gates, and dispatch token allocations.
• Billing and Provisions: App-based digital subscriptions are processed through native App Store in-app purchase mechanisms (Apple App Store / Google Play Store). Payments for physical-world concierge upgrades or custom physical logistics are handled directly via corporate payment processors in compliance with Apple App Store Guidelines §3.1.5(a) (Exemption for Physical Goods and Services). All fees are non-refundable except as mandated by platform provider terms.
3. ARTIFICIAL INTELLIGENCE & GENERATIVE OUTPUT DISCLAIMER
The Platform utilizes generative artificial intelligence, natural language processing, machine learning models, and interactive video avatars (collectively, the "AI Engine") to interact with individual users and groups.
• Limitation of Liability for AI "Hallucinations": User acknowledges and accepts that artificial intelligence outputs may occasionally contain inaccuracies, layout omissions, localized errors, or outdated information (commonly referred to as "hallucinations").
• Independent Verification: CacheVibesEnt, Inc. does not warrant or guarantee the accuracy, safety, safety parameters, allergen parameters, or reliability of any AI-generated recommendation. B2C consumers and B2B guests must independently verify all AI outputs, including operating hours, venue reservation windows, and safety parameters.
• Indemnification: CacheVibesEnt, Inc. shall not be held liable for any damages, economic losses, missed flights/reservations, personal injuries, or negative experiences resulting from a user’s reliance on AI-generated communications.
4. B2C SOCIAL OS, GROUP PLANNING, & VIBE CHECK PIPELINE
For individual consumer users, the platform provides group coordination and location-intelligence layers:
• Group Agent & Link Sharing: Registered Users (Hosts) can initiate group planning sessions and invite external peers via links. Invited peers can submit preferences and availability via web view without downloading the app. By submitting details, external peers agree to transient preference aggregation by our AI Engine.
• Vibe Check Data: The platform utilizes public data aggregation and scraping infrastructure (the "Vibe Check Pipeline") to assign dynamic vibe scores (0-100) and real-time crowd snapshots to nightlife venues. This data represents an analytical approximation based on public signals and historical models; it does not guarantee actual venue entry, wait times, or explicit crowd conditions.
5. THIRD-PARTY MARKETPLACE INTEGRATIONS & BOOKINGS
Our Platform relies on third-party Application Programming Interfaces (APIs) to surface availability, pricing data, and unified booking pathways across multiple verticals.
• API Paths: Core bookings for Hotels (Expedia Rapid API), Excursions (Viator Partner API), and Rental Cars are executed in-app via tokenized payment endpoints. Dining (Yelp Fusion / OpenTable) and select Nightlife operations utilize hybrid discovery deep-linking.
• Independent Contracts: All bookings are executed as binding agreements directly between the consumer user and the respective third-party service provider. CacheVibesEnt, Inc. is not a party, co-packer, or guarantor of those external transactions.
• Dispute Resolution: We accept zero liability for provider cancellations, pricing adjustments, service failures, or physical injuries occurring during an excursion or booking. Any transaction disputes or refund demands must be processed directly with the end merchant provider.
6. MOBILE MESSAGING & SMS COMPLIANCE DISCLOSURE
CacheVibesEnt, Inc. operates an automated mobile messaging program to deliver operational notifications, group RSVP tracking, platform nudges, emergency guest triage, and maintenance alerts to individual B2C app users, property guests, and B2B hosts.
• User Consent: By creating an account, interacting with our hardware kiosks, or providing your phone number within the Platform interface, you explicitly consent to receive automated operational and transactional text messages. Consent is not a condition of any purchase or transaction.
• Rates & Frequency: Standard message and data rates may apply based on your mobile carrier plan. Message frequency varies dynamically based on your explicit platform interactions and group coordination activity.
• Opt-Out Mechanism (STOP): You can cancel the SMS service at any exact time. Simply text STOP to our dedicated line +1 (678) 916-9936. Upon receipt of the "STOP" command, we will transmit a final confirmation text to verify you have been unsubscribed. Following this confirmation, you will receive no further mobile communications unless you explicitly re-initiate registration.
• Support (HELP): For operational assistance, text HELP to our messaging line, or contact our support architecture directly at support@cachevibes.com.
7. CAMERA PERCEPTION, SENSING & EPHEMERAL PRIVACY GATING
Select hardware kiosk deployments deployed by property hosts inside short-term rental environments feature localized computer vision and visual perception tools (utilizing Tavus Raven-1 frameworks) to evaluate ambient user engagement and service distress triggers.
• Zero Storage & Transmission: No video, audio, or photographic data is ever recorded, written to persistent storage, or transmitted over network infrastructure.
• Local In-Memory Evaluation: All video frames are processed ephemerally, transitorily, and strictly within local volatile RAM on the physical device. Data is purged within milliseconds of mathematical evaluation. This processing is utilized solely to adjust the AI avatar's conversational tone and, where authorized, to trigger local operational dispatch webhooks when property infrastructure failures are flagged by a guest.
8. B2B HARDWARE DEPLOYMENT & CUSTODY (FOR HOSTS/PROPERTY MANAGERS)
This section applies explicitly to corporate entities, property managers, and hosts who place physical hardware counter kiosks ("Kiosk Units") inside residential or commercial vacation rental units.
• Operational Custody: The Host assumes complete operational custody, physical security preservation, and environmental safety management for each physical Kiosk Unit placed within their managed footprints.
• Insurance Gating: The Host agrees to maintain property and liability insurance coverage sufficient to account for the theft, loss, vandalism, or destruction of the Kiosk Units during active guest tenancies or vacancy intervals.
• Hardware Replacement Fee: If a Kiosk Unit is stolen, cracked, physically damaged, or subjected to liquid ingress, the Host agrees to reimburse CacheVibesEnt, Inc. a standard hardware replacement fee of
$450.00 USD per unit.
9. INDEMNIFICATION & LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall CacheVibesEnt, Inc., its directors, affiliates, employees, or developers (including Bolder Apps LLC) be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, lost revenue, loss of data, or bodily injury arising from your use of the Platform or interactions with recommended vendors, even if we have been advised of the possibility of such damages.
Notwithstanding anything to the contrary contained herein, our total liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the lesser of the amount paid by you to us during the six (6) month period preceding the event giving rise to the claim or $500.00 USD.
10. GOVERNING LAW & JURISDICTION
These Terms and your use of the Platform are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located within the State of Delaware, and the parties hereby consent to personal jurisdiction and venue therein.
